Terms of Service
Effective Date: June 12, 2026 · Marietta Project Management, LLC d/b/a MPM Tek ProTek IT
These Terms of Service ("Terms") govern your access to and use of the cybersecurity services, website, and client portal provided by Marietta Project Management, LLC d/b/a MPM Tek ProTek IT ("ProTek IT," "we," "us," or "our"), located at 1769 Fair Oak Way, Mableton, Georgia 30126. By accessing our services or clicking "I agree" at checkout, you agree to be bound by these Terms. If you do not agree, do not purchase or use our services.
1. Services Provided
ProTek IT provides managed cybersecurity services through a combination of Guardz, SentinelOne, and Check Point platforms.
1.1 Service Tiers

2. What ProTek IT Does and Does Not Provide
2.1 Included
- 24/7 automated AI-powered threat monitoring across endpoint, identity, email, cloud, and dark web
- Security awareness training modules and phishing simulation campaigns
- Monthly or quarterly security reports depending on plan tier
- Cyber insurance eligibility documentation (Professional and Business tiers)
2.2 NOT Included
- Guarantee that all threats will be detected — no platform provides absolute protection
- 24/7 live human SOC staffing — automated AI detection is the primary mechanism
- Incident response, forensic investigation, or legal support following a breach
- Recovery of data lost due to a cyberattack
- HIPAA BAA unless separately executed
3. Billing and Payment
3.1 Subscription Fees
Services are billed monthly or annually in advance via Stripe. Subscriptions auto-renew.
3.2 Free Plan
The Free plan may be modified or discontinued with 30 days notice. No SLA commitments.
3.3 Failed Payments
Payment retried up to 3 times over 7 days. Service suspended if payment fails. ProTek IT is not liable for incidents during suspension caused by non-payment.
3.4 Taxes
All fees exclude taxes. Georgia SaaS cybersecurity monitoring services are currently exempt from Georgia sales tax under O.C.G.A. § 48-8-2.
4. Cancellation and Refunds
Monthly: Cancel anytime; retain access through end of paid period; no partial-month refunds. Annual: Refunds available within 14 days of renewal if no incidents reported. After 14 days, no refunds.
5. Client Responsibilities
- Provide accurate user count and notify within 48 hours when it changes
- Install and maintain endpoint agent on all covered devices
- Respond to CRITICAL alerts promptly
- Maintain independent data backups
- Notify ProTek IT immediately of any suspected breach
6. Data and Privacy
ProTek IT accesses metadata about users, devices, emails, and cloud applications to deliver security services. We do not read email content except to identify threats. Data is stored in a multi-tenant database with row-level security. Retained for 12 months active, deleted 30 days after cancellation.

8. Governing Law
Governed by Georgia law. Disputes resolved by binding arbitration in Cobb County, Georgia. CLASS ACTION WAIVER: disputes resolved on individual basis only.
