Managed Security Service Agreement

Electronic Acceptance

By checking "I agree to the MSP Service Agreement" at checkout, you agree to be bound by this Agreement. Electronic acceptance is legally binding under the E-SIGN Act and O.C.G.A. § 10-12-1 et seq.

This Managed Security Service Agreement is between Marietta Project Management, LLC d/b/a MPM Tek ProTek IT ("Service Provider") and the client whose information is provided at checkout ("Client"). By checking the "I agree" box at checkout, Client agrees to be bound by this Agreement and the ProTek IT Terms of Service.

2. Service Level Commitments

Platform availability: 99.9% uptime monthly, excluding maintenance and force majeure.

4. Onboarding

Service Provider contacts Client within 1 business day of purchase to schedule onboarding. Client must provide M365/Google Workspace admin credentials, install endpoint agents, and enroll users. Full onboarding targeted within 5 business days.

5. Term and Termination

Term begins on date of first payment. Client may cancel anytime via portal or email. Termination takes effect at end of current billing period. Client data retained 30 days post-termination then permanently deleted.

Service Provider may terminate immediately for: non-payment after 14 days, material breach uncured after 10 days notice, unlawful use, or service discontinuation with 30 days notice.

6. Limitation of Liability

Services provided as-is. No warranty against all security incidents. Maximum liability = fees paid in prior 3 months. No liability for indirect or consequential damages.

7. Electronic Acceptance

By checking "I agree" at checkout, Client confirms they have read and agree to this Agreement and the ProTek IT Terms of Service. Electronic acceptance is legally binding under the E-SIGN Act and O.C.G.A. § 10-12-1 et seq.
